FMLA and ADA Scenarios & Best Practices

Via Zoom

11:30 AM – 1:00 PM

ABOUT THE SPEAKER:

Robert J. Simandl – von Briesen & Roper, s.c.

Bob counsels employers on all aspects of workplace compliance including hiring, disciplining and terminating employees. He also has experience with accommodation obligations, wage and hour issues, affirmative action, discrimination complaints, non-competition agreements and employee handbook design and development. Bob has represented employers before the federal district courts, National Labor Relations Board, 7th Circuit Court of Appeals and a number of administrative agencies and tribunals, including the Wisconsin Employment Relations Commission, Wisconsin Equal Rights Division and Equal Employment Opportunity Commission.

ABOUT THE PROGRAM:

FMLA, ADA, GINA, COVID, OSHA and the rest of the alphabet soup impacts employers in meeting their employment/labor law obligations on a daily basis.  But what does this all really mean?

Bob Simandl, a Shareholder in the Green Bay office of von Briesen & Roper, s.c., will discuss the compliance obligations for employers based on a review of case scenarios; discussing how the pieces all come together.  Bob will review FMLA situations and discuss not only the FMLA compliance obligations of employers but also how these cases impact other areas of compliance responsibilities.   The discussion will focus on “best practices” in legal compliance and reflect the practical side of compliance responsibility.

Learning Objectives and Actions Steps:

1.      Understanding the policies and procedures that employers should consider for the effective administration of the FMLA and companion laws.

2.      In analyzing a request for FMLA, the processes an employer should adopt in defining eligibility and return-to-work opportunities.

3.      How ADA, Worker’s Compensation and other laws fit into the compliance matrix relative to a “serious health condition.”

4.      The steps to take to create a Disability Leave Management Program that encompasses an employer’s legal and practical obligations.
