    Unfortunately, companies periodically need to conduct investigations into allegations of employee misconduct. Misconduct can include a diverse number of topics including, but not limited to, sexual harassment, discrimination, embezzlement, misuse of a company's computer system, information posted about a company on a blog, employee theft, workplace violence, rules violations, drug or alcohol use, and numerous other issues.

    Sometimes the alleged wrongful conduct involves illegal activity involving law enforcement investigators. However, on other occasions, the primary focus of the investigative inquiry is on wrongful, but noncriminal conduct implicating well-established company policies and procedures.

    Handled incorrectly either of these types of investigations, criminal or noncriminal conduct, will often create the possibility of civil liability to your organization, its managerial personnel or individual employees. Even more troubling is that the alleged wrongdoers may be the most senior directors and officers of the company.
